INTERPOL DIFFUSIONS
INTERPOL DIFFUSIONS
INTERPOL Diffusions provide another mechanism through which to request international cooperation in INTERPOL’s system, intended to further facilitate collaboration between law enforcement authorities of its member countries. Our law firm, headed by Arantxa Geijo and Francisco Estevan, delivers dedicated legal counsel and representation in matters concerning INTERPOL Diffusions, with the aim of upholding fundamental rights.
WHAT IS AN INTERPOL DIFFUSION?
An INTERPOL Diffusion is issued for similar purposes as INTERPOL’s notices, and they follow the same colour-coded system used for notices. However, they are sent directly by the requesting member country’s National Central Bureau (NCB) to the selected member state(s), complying with the same rules and restrictions which are applied to notifications.
Although INTERPOL’s Diffusions are considered less formal than notifications, diffusions may carry significant ramifications for a targeted individual, causing them to be subject to investigations and possible consequent restrictions.
TYPES OF INTERPOL DIFFUSIONS
Member countries can issue, amongst others, Red, Blue, and Silver Diffusions which are emitted directly to the desired state(s) in order to request the location and arrest of persons, the collection of additional information about a person related to a criminal activity, or to identify and trace criminal assets, respectively.
Specifically, the compliance of Red Diffusions, which request the arrest, detention or restriction of movement of a concerned individual, are assessed by INTERPOL’s Notices and Diffusions Task Force.
Similarly to INTERPOL’s notices, all diffusions, regardless of their form, must adhere to INTERPOL’s constitutional principles and its rules governing the processing and handling of data.
IMPACT AND CONSEQUENCES OF A DIFFUSION
The specific consequence of a diffusion will depend on the particular type of diffusion which is issued. Moreover, as with notifications, it is up to the receiving country to independently assess and determine whether to act on the request made through INTERPOL’s channel.
However, the function of all diffusions is to encourage rapid and efficient cooperation between police authorities internationally. Thus, they have similar effects as their corresponding notices, ranging from imposed restrictions to reputational damage.
As a result, the involvement of lawyers with expertise in both INTERPOL matters and the field of international criminal law is critical to the protection of fundamental rights and the evaluation of available legal recourse.
DEFENCE AND MANAGEMENT OF DIFFUSIONS
Our firm is able to provide structured and multi-faceted strategies which include:
- Assessment of the diffusion, focusing on its legal effect and operational scope.
- Evaluation of any risks posed to fundamental rights.
- Preparation and filing of submissions to challenge the diffusion.
- Development of an effective international defence through engagement with foreign counsel and relevant authorities.
Our firm works towards protecting client rights at the administrative, judicial and international levels, alongside limiting the effects of the diffusion on the client.
EXTRADITION-RELATED PROCEDURES OF RED DIFFUSIONS
Similarly to Red Notices, Red Diffusions may correlate with requests for extradition of the concerned individual. Our firm’s international nature makes it uniquely adept at coordinating with local counsel and national courts, as well as international authorities and bodies, to effectively and efficiently:
- Analyse the extradition request’s conformity with the applicable laws.
- Develop legal pleadings and appellate arguments before the competent courts.
- Monitor compliance with international treaties, ensuring the effective protection of fundamental rights.
INTERNATIONAL EXPERIENCE AND COMPLEX LITIGATION
Having represented clients before various courts and international bodies, our firm has significant experience in cross-border disputes and international litigation. Hence, our approach combines:
- Methodical and structured legal defence.
- External expertise from international experts and forensic specialists.
- Coordination of multi-layered administrative and judicial procedures.
